Guidelines for seeking information from JUU Ride

Introduction

The following are the guideline(s) and/ or process(es), to be followed by any person(s) and/ or authority(ies) and/ or department(s) and/ or agency(ies) and/ or any person(s) who have an interest in the information so sought. These are merely guideline(s) and/ or process(es), which may change at any time.

These guideline(s) and/ or process(es) adopted by JUU Ride is to give the information seeker, a path to follow legally and get the necessary information.

These guideline(s) and/ or process(es) adopted by JUU Ride is well within legal framework and wherever the same is shown as contradictory, to our satisfaction, then the proper guideline(s) or process(es) as shown by that or any law shall be followed or adopted after the same is incorporated.

These guideline(s) and/ or process(es) adopted by JUU Ride has two class;

LAW ENFORCEMENT AGENCIES which cover all the authority(ies) and/ or department(s) and/ or agency(ies) that are tasked with the law enforcement.

THIRD PARTY includes the direct users of the JUU Ride platform and shall also cover all other person(s) and/ or authority(ies) and/ or department(s) and/ or agency(ies) and/ or any person(s) who have an interest in the information so sought and who does not fall under Law Enforcement Agencies.

This “Guidelines for seeking information from JUU Ride” shall include and be read as part of this document, all those word(s) and/ or term(s) and/ or definition(s) and/ or meaning(s) and/ or anything that is not mentioned here in but is mentioned elsewhere in the JUU Ride website or document(s).

Guidelines for Law Enforcement Agencies

We disclose business records and/ or any other information sought only in accordance with law, as per our Terms and Conditions with Guests and Service Providers and as per this “Guidelines for seeking information from JUU Ride”.

Concerned person(s) seeking the information shall disclose the following :

  • Name
  • Designation in the concerned authority(ies) and/ or department(s) and/ or agency(ies)
  • Authority to seek the information so sought
  • Letter of representation giving you authority to seek the information so sought
  • The reasons for the information sought for
  • Details of the information sought for
  • Any legal document/ order/ record(s) from concerned and/ or competent authority(ies) and/ or competent court(s)

Concerned person(s) seeking the information shall share the above details, and request Agnibhu

In Case of Emergency

In case of emergency(ies), at the discretion of Agnibhu, shall share the above details, and request Agnibhu via phone number 08172-355146, and/ or any other media.

In such cases of emergency(ies), Agnibhu at its discretion, after verifying the fact of emergency(ies) and depending on the importance and seriousness of document or information so sought for, shall then share after verifying the veracity of the details given by the concerned person representing such concerned authority(ies) and/ or department(s) and/ or agency(ies).

Sharing of such information in such cases of emergency(ies) shall be under the sole responsibility of such concerned authority(ies) and/ or department(s) and/ or agency(ies).

Also, Agnibhu at its discretion may decide that the information sought for does not fall under the category of emergency(ies) and may thus ask you to follow the proper channel of guidelines and get the information/ document so sought for from Agnibhu. This exercise of such discretion is the right of Agnibhu and hence should not be and shall not be considered as a wrong or wrongful act in any way by you or authority(ies) and/ or department(s) and/ or agency(ies).

If Agnibhu at its discretion decide that the information sought for does not fall under the category of emergency(ies) and thus ask you to follow the proper channel of guidelines and get the information so sought for from Agnibhu then:

  • You shall then accordingly follow the proper channel of guidelines and get the information/ document so sought for OR
  • You shall then show and give reason(s) for such emergency(ies) with proper document(s). Then you will accordingly be guided by Agnibhu and the information/ document so sought for shall be shared or provided.

Even after all these and even after you establishing such emergency(ies) for such document(s) or information(s) so sought for and Agnibhu after exercising its discretion finds it to be a case of emergency, shall still be bound by law which requires it to ask you or insist you to produce or give or share such record(s) and/ or order(s) from the competent authority(ies) and/ or competent court(s).

Acceptance of Request and its Consequence

Our acceptance of request and/ or while sharing and / or during the sharing of information/ document so sought shall not and does not waive any legal objection(s)/ obligation(s) that Agnibhu Technologies Private Limited may have and may raise in response to such request(s).

Agnibhu shall share the information or document so sought for only based on our record(s) and record(s) on order(s) of and from authority(ies) and/ or department(s) and/ or agency(ies) and/ or competent court(s). If Agnibhu at its discretion raises an objection on such record(s) and/ or order(s) of and from authority(ies) and/ or department(s) and/ or agency(ies) and/ or competent court(s), and rejects the same, with the consequence of not sharing the information or document so sought for then, it would be your duty to get and submit such record(s) and/ or order(s) of and from authority(ies) and/ or department(s) and/ or agency(ies) and/ or competent court(s) based on which the information so sought for can be comfortably and within the legal frame be given/ shared.

We do not accept oral requests for information under any circumstances.

We only respond to request(s) on email if it is coming from an email address, from an official government domain or postal request(s)/ notice(s) on valid official letter head with signature of the authorized official with proper seal or valid court order(s) or notice(s) from court of law.

In case we have any doubt(s), on the authenticity of the request or the person requesting the information we could ask you to provide additional document/ information before we process the request for information.

We review each request for facial and substantive validity, and will reject request(s) that are not facially and substantively valid. Among other things, we require requests to be narrowly tailored to a legitimate law enforcement need and will reject overly broad, vague, or unduly burdensome requests. In order to make sure your Law Enforcement request(s) is valid and does not seek more information than necessary, we ask for the following:

  • A sufficiently narrow/ defined time period
  • A specific event or action that the subject took
  • A specific reference (i.e., you must uniquely identify a Guest or Service Provider)

We disclose data to Law Enforcement agency(ies) when we determine that we are required to do so by law. In those instances, we will search for and disclose data that we are reasonably able to locate and retrieve.

We may notify subjects before producing their information to Law Enforcement agency(ies), unless we are prohibited by any order(s) under any law or by any law from doing so, or in exceptional circumstances as established by you to us with by any order(s) under any law or by any law and convince us convincingly.

We will not be able to provide in-person or expert witness testimony.

Guidelines for Third Party Data Requests and Service of Legal Documents

We disclose business records and/ or any other information sought only in accordance with law, as per our Terms and Condition with Guests and Service Providers and as per “Guidelines for seeking information from JUU Ride”.

Any data request should be directed to “Agnibhu Technologies Private Limited”. We generally require a valid request issued in accordance with applicable law before we can process private requests for information. Our acceptance of legal process does not waive any legal objections we may have and may raise in response to the request.

We review each subpoena or data request for facial and substantive validity, and will reject requests that are not facially and substantively valid. Among other things, we require requests to be narrowly tailored, and will reject overly broad, vague, or unduly burdensome requests. Before making a request, please check to see if the information sought is publicly available.

In order to make sure your request is valid; we ask for the following:

  • A sufficiently narrow/ defined time period, and the specific data requested within that time period
  • A specific identifying reference (i.e., you must uniquely identify a Guest or Service Provider, ideally by more than just a name)
  • Your contact information (i.e., name, address and email address and/ or phone number)

When we determine that we are required by law to disclose data, we will search for and disclose data that we are reasonably able to locate and retrieve.

Please note that we will only review and respond to emergency requests from law enforcement sent to support.lawenforcement@juuride.com, and will not respond to any requests sent to this email address other than by the law enforcement officials.

We may notify the Third Party or the other person(s) about whom you are seeking the information or law enforcement authority(ies) and/ or department(s) and/ or agency(ies) before giving the information sought for, unless we are prohibited by law from doing so, and will be able share the information only after their approval or in exceptional circumstances as established by you to us with by any order(s) under any law and convince us convincingly.

We will not provide in-person or expert witness testimony.
